General
By purchasing, selling, trading, or otherwise engaging with Capital City Sports Cards Inc. (“we,” “us,” or “our”), you (“customer,” “user”) agree to be bound by these Terms and Conditions.
Authenticity Disclaimer
While we make reasonable efforts to verify the authenticity of sports collectibles, all items are sold “as is.” We do not guarantee the authenticity, provenance, or certification of any item unless explicitly stated in writing. Customers are encouraged to conduct their own due diligence prior to purchase.
Condition of Items
All collectibles are sold in their current condition. We do not guarantee condition grades unless explicitly specified. Minor defects, wear, or aging may be present.
Product Descriptions and Data Accuracy
We strive to ensure that all product descriptions, images, pricing, and related information are accurate; however, errors may occur.
We are not liable for any inaccuracies, omissions, or typographical errors, including but not limited to:
-Incorrect descriptions of items
-Incorrect player, team, or event attribution
-Pricing or listing errors
-Data entry mistakes
We reserve the right to correct any errors and to cancel or refuse orders affected by such inaccuracies at our sole discretion.
AI-Generated Content Disclaimer
Some product descriptions, images, or other content may be generated or assisted by artificial intelligence systems. Such content is provided for informational and illustrative purposes only.
We make no representations or warranties regarding the accuracy, completeness, reliability, or authenticity of AI-generated content. AI-generated images may not precisely reflect the actual item.
Capital City Sports Cards Inc. shall not be liable for any loss or damages arising from reliance on AI-generated content.
No Reliance
You acknowledge and agree that you have not relied on any representations, warranties, statements, or information—whether oral, written, digital, or visual—other than those expressly set out in these Terms and Conditions.
Without limiting the foregoing, you specifically agree that you have not relied on:
-Product descriptions, listings, or summaries
-Images or photographs (including AI-generated images)
-Statements regarding authenticity, condition, or value not expressly guaranteed in writing
-Any opinions, estimates, or projections of value or future resale potential
All purchasing decisions are made at your own discretion and risk.
Consumer Acknowledgement of Independent Verification
You acknowledge that you have had a full and fair opportunity to independently inspect, review, and verify the condition, authenticity, and value of any item prior to purchase.
You further acknowledge that you have either conducted such independent verification or voluntarily chosen not to do so, and that you are not relying on Capital City Sports Cards Inc. to provide verification beyond what is expressly stated in writing.
No Rescission / No Reversal
To the fullest extent permitted by applicable law, all transactions are final and binding upon completion. You expressly waive any right to rescind, cancel, reverse, or set aside a transaction on any basis, including but not limited to:
-Misrepresentation (except where such waiver is prohibited by law)
-Mistake (unilateral or mutual)
-Non-disclosure
-Reliance on descriptions, images, or AI-generated content
-Changes in market value or buyer’s remorse
You agree that no transaction shall be reversed, refunded, or unwound except at the sole and absolute discretion of Capital City Sports Cards Inc., as expressly set out in writing.
Exclusion of Negligent Misrepresentation
To the fullest extent permitted by applicable law, Capital City Sports Cards Inc. disclaims all liability for any negligent misrepresentation.
Without limiting the foregoing, Capital City Sports Cards Inc. shall not be liable for any loss or damage arising from any inaccurate or incomplete information provided, whether negligently or otherwise, including but not limited to product descriptions, images, data entry, or AI-generated content, except where such exclusion is not permitted under applicable law.
No Warranties
To the fullest extent permitted by law, all products and services are provided without warranties of any kind, whether express or implied, including but not limited to:
-Merchantability
-Fitness for a particular purpose
-Non-infringement
Limitation of Liability
To the maximum extent permitted by applicable law, Capital City Sports Cards Inc. shall not be liable for any:
-Direct, indirect, incidental, or consequential damages
-Loss of profits, data, or business opportunities
-Claims arising from authenticity disputes, valuation changes, data errors, AI-generated content, or resale outcomes
In all cases, our total liability shall not exceed the amount paid for the item in question.
Assumption of Risk
By purchasing or handling collectibles, you acknowledge that:
-Market values may fluctuate significantly
-Items may degrade over time
-Authentication opinions may change
-Descriptions and images (including AI-generated content) may contain inaccuracies
You assume all risks associated with ownership and use.
Third-Party Authentication
Any third-party grading or authentication (e.g., PSA, Beckett, etc.) is the opinion of that entity only. We are not responsible for errors, changes, or disputes related to third-party assessments.
Returns and Refunds
All sales are final unless otherwise stated in writing. We reserve sole discretion in approving any return or refund requests.
Indemnification
You agree to indemnify and hold harmless Capital City Sports Cards Inc., its owners, employees, and affiliates from any claims, damages, or legal actions arising from:
-Your use or resale of items
-Reliance on product descriptions, data, or AI-generated content
-Disputes with third parties
-Breach of these Terms
Online Acceptance (Clickwrap Agreement)
For online transactions, you acknowledge and agree that by clicking a checkbox, button, or similar mechanism indicating acceptance of these Terms and Conditions (including but not limited to “I Agree” or completing a purchase), you are entering into a legally binding agreement.
You further agree that such electronic acceptance constitutes valid and enforceable consent equivalent to a handwritten signature.
Chargebacks and Payment Disputes
You agree not to initiate any chargeback, payment reversal, or dispute with your payment provider without first contacting Capital City Sports Cards Inc. to attempt resolution.
To the fullest extent permitted by applicable law, you waive any right to unjustified chargebacks. In the event of a chargeback or payment dispute initiated in violation of these Terms, you agree that:
-You remain liable for the full amount of the transaction
-We may recover all associated costs, including administrative fees, chargeback fees, and collection costs
-We reserve the right to provide these Terms and transaction records to the payment processor as evidence of your agreement
Dispute Resolution / Arbitration
To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms or any transaction shall be resolved by final and binding arbitration.
Such arbitration shall be conducted in the Province of Alberta, Canada, and you agree to submit to the exclusive jurisdiction of Alberta for any permitted court proceedings.
You waive any right to participate in class actions or collective proceedings.
Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Capital City Sports Cards Inc. and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
No statement, representation, or promise not expressly set out in these Terms shall be binding or have any legal effect.
Governing Law
These Terms shall be governed by the laws of the Province of Alberta and the applicable federal laws of Canada.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Amendments
We reserve the right to update or modify these Terms at any time without prior notice.
Acceptance
By completing a transaction or engaging with our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
